Terms of Service

Last updated: October 30, 2026

These Terms of Service (“Terms”) are an agreement between you and OnCallGenie LLC (“OnCallGenie,” “we,” “us”) and govern your use of our website, our iOS and Android apps, and related services (together, the “Service”).

By signing in to or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a hospital, medical group, or other organization (an “Organization”), you confirm that you are authorized to accept these Terms for it. If your Organization has a separate written agreement with us, that agreement controls where it conflicts with these Terms.

1. The Service

OnCallGenie helps Organizations build, publish, and view on-call and shift schedules for their staff, including tools for scheduling rules, automated schedule generation, and AI-assisted rule entry. We may add, change, or remove features over time.

2. Not a substitute for clinical judgment

The Service is a scheduling tool. It does not provide medical advice and does not decide who is qualified, credentialed, or fit to provide care. Your Organization remains solely responsible for its staffing decisions, for confirming that every shift is covered by appropriately qualified people, and for meeting any regulatory, accreditation, or labor requirements. Always confirm critical coverage through your Organization’s official channels, especially if the Service is unavailable or a schedule looks wrong.

3. Accounts and access

  • You sign in with a one-time code sent to your email or through your Organization's single sign-on. Keep access to your email account secure, and tell us promptly if you believe your account has been used without permission.
  • Each Organization controls who can access its workspace and with what role (admin, member, or viewer). Administrators can invite, change, and remove members.
  • You must provide accurate information and may not share your account or impersonate anyone.
  • You must be at least 16 years old and using the Service for professional purposes.

4. Your content

“Your Content” means the information you or your Organization put into the Service, such as provider records, availability, schedules, and scheduling rules. Your Organization owns its content. You give us permission to host, process, and display Your Content only as needed to provide, secure, and support the Service, as described in our Privacy Policy.

You are responsible for Your Content and confirm that you have the right to enter it. In particular:

  • Do not enter patient information or other protected health information. The Service is designed for staff scheduling only.
  • Only enter information about staff members that your Organization is permitted to use for scheduling.

5. AI-assisted features

Some features use artificial intelligence to turn plain-language requests into scheduling rules or to suggest schedules. AI output can be incomplete or wrong. Review every suggestion before applying it; nothing is saved until a user applies it, and you are responsible for the rules and schedules you choose to use. AI features may be subject to usage limits.

6. Acceptable use

You agree not to:

  • Access, or try to access, another Organization's data or any part of the Service you are not authorized to use.
  • Probe, scan, or test the security of the Service without our written permission, or interfere with its operation.
  • Use automated means to access the Service in a way that places an unreasonable load on it, or get around rate limits.
  • Copy, resell, reverse engineer, or build a competing product from the Service, except as the law expressly allows.
  • Use the Service to break the law, infringe others' rights, or send spam or harmful content.

If you find a security vulnerability, please report it to support@oncallgenie.com rather than exploiting it.

7. Fees

Any fees for the Service will be set out in an order form or other agreement with your Organization. If we introduce fees for features that are currently free, we will tell you in advance, and you can stop using those features before the fees apply.

8. Our intellectual property

The Service, including its software, design, and branding, belongs to OnCallGenie LLC and its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your Organization’s internal scheduling during your subscription or permitted use. If you send us feedback or suggestions, we may use them without any obligation to you.

9. Third-party services

The Service relies on third-party providers for hosting, authentication, email, and AI features, and may work with your Organization’s identity provider for single sign-on. Your use of the mobile apps is also subject to the terms of the Apple App Store or Google Play. We are not responsible for third-party services we do not control.

10. Suspension and termination

You can stop using the Service at any time, and you can leave an Organization from within the Service. An Organization can remove members at any time. We may suspend or end access to the Service if you breach these Terms, if your use creates a security or legal risk, or if we are required to by law. Where reasonable, we will give notice first. Sections that by their nature should survive termination (including Your Content responsibilities, disclaimers, limitation of liability, and indemnity) will survive.

11. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, OnCallGenie disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that generated schedules or AI suggestions will be accurate, complete, or compliant with any requirement.

12. Limitation of liability

To the fullest extent permitted by law, OnCallGenie will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service, including staffing or coverage gaps. Our total liability for all claims relating to the Service will not exceed the greater of the amounts your Organization paid us for the Service in the twelve months before the claim arose or one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

13. Indemnity

You and your Organization agree to defend and hold harmless OnCallGenie LLC from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your breach of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the United States and of the state in which OnCallGenie LLC is organized, without regard to conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other; you can reach us at support@oncallgenie.com. Any claim that cannot be resolved informally will be brought in the state or federal courts located in that state, and both parties consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and if the changes are significant we will provide notice in the Service or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.

16. General

These Terms, together with our Privacy Policy and any written agreement with your Organization, are the entire agreement about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
